Terms of Service

1. Eligibility & accounts

You must be at least 18 years old and able to form a binding contract to use Jobistic. You are responsible for the accuracy of your account information and for all activity under your account. Keep your credentials secure and notify us immediately of any unauthorized use.

One account per person. Each individual may hold only one Jobistic account, and each phone number may be verified on only one account. Creating or operating multiple or duplicate accounts — including using different email addresses to register more than one account, or verifying the same phone number across several accounts — is strictly prohibited. If we detect duplicate accounts, we may, at our sole discretion and without notice, suspend or permanently terminate any and all of the accounts involved, including your original account, and revoke any associated Connects, credits, balances, or benefits. Attempting to evade this rule (for example, by using additional phone numbers or identities) is itself a violation of these Terms.

2. The marketplace

Jobistic connects employers (who post jobs and projects) with workers (who apply and deliver work). Jobistic is a venue only: we are not a party to the agreements formed between employers and workers, and we do not employ workers. Each user is solely responsible for evaluating and fulfilling the engagements they enter into.

3. Review & approval

Job posts, project posts, and profiles may be reviewed by Jobistic before they become publicly visible. We may approve, reject, or remove any content or account, at any time, that we reasonably believe violates these Terms, our Acceptable Use Policy, or applicable law.

4. Fees, Connects & payments

• Workers may purchase “Connects” to submit proposals, and both parties may subscribe to paid plans. Prices are shown at checkout.
• Service fees may be deducted from payments processed through the platform, as disclosed in your plan.
• All purchases generate an invoice available in your Billing section. Taxes may apply based on your location.
• Payments are handled by third-party payment providers; by paying, you also agree to those providers’ terms.

5. Your content

You retain ownership of content you submit (profiles, proposals, deliverables, messages). You grant Jobistic a worldwide, non-exclusive licence to host, display, and distribute that content as needed to operate the platform. You represent that you have the rights to the content you post and that it does not infringe others’ rights.

6. Communications consent

By providing contact details on the platform — including your phone number, email address, or messaging handles — you authorize Jobistic and Vardiano Technologies to contact you for account, transactional, service, marketing, sales, and promotional purposes by phone call, SMS/text, WhatsApp and other messaging apps, email, and in-app or push notifications, including via automated systems and pre-recorded messages where permitted by law. You confirm any number you provide is yours. Consent to marketing or sales calls/texts is not a condition of any purchase, and you may opt out at any time (reply STOP, use the unsubscribe link, change your notification settings, or email privacy@jobistic.io); essential transactional messages will still be sent. These communications are handled in accordance with applicable laws — including the US TCPA and CAN-SPAM Act, California CCPA/CPRA, EU/UK GDPR and PECR, Canada’s CASL, Australia’s Spam Act 2003, and India’s DPDP Act 2023 — as detailed in our Privacy Policy.

7. Prohibited conduct

You must not use Jobistic for any illegal, deceptive, or harmful purpose, including illegal hiring or working arrangements, fraud, circumventing fees, harassment, or infringing intellectual property. See the Acceptable Use Policy for details. Violations may result in content removal and account suspension or termination.

8. Disputes between users

Employers and workers should first attempt to resolve disputes directly. Where escrow or milestone features are used, funds are released according to the agreed terms. Jobistic may, at its discretion, provide mediation but is not obligated to resolve disputes.

9. Suspension & termination

We may suspend or terminate your access if you breach these Terms, create risk or legal exposure, or engage in prohibited conduct. You may close your account at any time. Certain obligations survive termination, including fees owed and the sections on content licence, disclaimers, and liability.

10. Disclaimers

The platform is provided “as is” and “as available”. We do not guarantee the conduct, qualifications, or work quality of any user, or that the platform will be uninterrupted or error-free.

11. Limitation of liability

To the maximum extent permitted by law, Jobistic and Vardiano Technologies will not be liable for indirect, incidental, or consequential damages, or for amounts exceeding the fees you paid to us in the 12 months before the claim.

12. Indemnification

You agree to indemnify Jobistic and Vardiano Technologies against claims arising from your use of the platform, your content, or your breach of these Terms.

13. Changes

We may update these Terms from time to time. Material changes will be notified via the platform or email. Continued use after changes take effect constitutes acceptance.

14. Governing law

These Terms are governed by the laws applicable to Vardiano Technologies’ place of incorporation, without regard to conflict-of-laws rules. This document is a general template and should be reviewed by qualified legal counsel for your jurisdiction.
